Parenting Time (Formerly Known as “Access”)

There are many factors that the court will consider in their analysis of the best interests of the child/ren when determining parenting time/access schedules. You should not make any assumptions. You should not believe the myths that are widely spread among the population. For example, one of which is a myth that only mothers receive primary care of the children.

When determining parenting time/access schedules, the court will consider several factors. They include: age of the child, historical roles of the parents, post-separation involvement. Other factors include: ability to facilitate time of the other parent, family violence, needs of the child of that age, and many other factors. Some factors may or may not be applicable or determinative to your particular case.

Although sometimes one party may obtain a litigation advantage by making false claims, it is important to know that eventually, the court will find out the truth. The court will have a chance to carefully consider all the relevant factors. If a false claim has been made, it will work against the party who had made the claim. It will eliminate the original litigation advantage. In other words, a short-term gain will sacrifice the long-term result.
